By downloading, installing, or using Now Playing Notify ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
Now Playing Notify is a macOS menu bar application that displays notifications when tracks change in the Spotify desktop application. The App is developed by Tom McFarlin ("we," "us," or "our").
To use the App, you need:
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices you own or control.

The App interacts with Spotify's desktop application and services. Your use of Spotify is governed by Spotify's own terms of service and privacy policy. We are not affiliated with, endorsed by, or sponsored by Spotify AB.

To the maximum extent permitted by applicable law, in no event shall Tom McFarlin be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
You agree to indemnify, defend, and hold harmless Tom McFarlin from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the App or violation of these Terms.
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
We may revise these Terms from time to time. The most current version will always be available within the App or on our website. By continuing to use the App after revisions become effective, you agree to be bound by the revised Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Georgia, without regard to its conflict of law provisions.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between you and Tom McFarlin regarding the App and supersede all prior agreements and understandings.
